- Why Landlords need to complete an electrical inspection and testing?
There are two main Acts of Parliament that impose a statutory duty on landlords with respect to the safety of electrical equipment:
1. The Consumer Protection Act 1987 landlords electrical testing obligations.
2. The Health and Safety at Work etc. Act 1974
The Consumer Protection Act affects all persons who let property in the course of their business because it defines them as "suppliers", i.e. they are supplying goods to the tenant. If you let property you must ensure that the electrical system and all appliances supplied are safe – failure to comply with the Electrical Equipment (Safety) Regulations 1994 and the The Consumer Protection Act 1987 is a criminal offence and may result in:
- A financial fine
- Imprisonment
- Possible manslaughter charges in the event of deaths
- The Tenant may also sue you for civil damages
- Your property insurance may be invalidated
These regulations are enforced by the Health & Safety Executive
- Why businesses need to complete an electrical and inspecting and testing?
The law requires that all business owners, their directors, managers and employees comply with "The Electricity at Work Regulations". The law simply requires that all electrical systems must be maintained to be safe at all times.
Test reports, together with other preventative maintenance documentation will form the basis of this proof and will provide your best defence against prosecution should the need arise.
- EICs and MEIWCs
Electrical Installation Certificates (EICs) and Minor Electrical Installation Works Certificates (MEIWCs) provide you, as the person responsible for the safety of an electrical installation, with a declaration that the new installation, or alteration or addition, is safe to use at the time it was put into service.
- EICR
Electrical Installation Condition Report (EICR) formerly called Periodic Inspection Report (PIR) is an electrical survey to reveal if electrical circuits are overloaded, find potential hazards in the installation, highlight any lack of earthing or bonding and carry out tests on the fixed wiring of the installation. The report is known as an Electrical Installation Condition Report (EICR) and will establish the overall condition of all the electrics, state whether it is satisfactory for continued use and detail any work that might need to be done.
